The term “compensation culture” has come into popular use over the past decade or so and is often employed in a derogatory manner. However, not all of us are entirely sure what the catchy phrase actually means. In short, “compensation culture” could be said to refer to the popular mindset that an individual is automatically entitled to receive compensation (or some sort of payout) in almost any situation, regardless of where the blame for an incident may actually lie. When speaking of the early roots of this attitude, many individuals will point towards the Stella Liebeck case of 1992, where an elderly woman was awarded $2.9 million in damages after she spilt a hot cup of Mcdonald’s coffee over her own lap. Since this point, it is believed that many people sue and claim others for almost anything, even if they haven’t genuinely experienced any significant trauma or inconvenience as a result of the mistake at hand. Many argue that this attitude is encouraged by the onslaught of commercials that fill television advert breaks and radio airwaves, encouraging people to claim for all sorts of incidents and accidents when they may never have considered doing so before. Now, of course, to falsely claim or exaggerate the repercussions of an event is morally wrong. Not only is it unfair to the individual, agency, or company you are claiming against, but it has a wider impact on others in society. As more people claim, insurance premiums go up, making them unaffordable to many who need them. However, it is important to remember that not every claim is false. There are plenty of circumstances where you may indeed be entitled to a payout due to the wrongs or neglect of another. So, for now, let’s take a look at instances where making a claim is not only acceptable but is actually advised and should be encouraged.

Personal Injury

Ideally, we’d live in a world where personal injury claims wouldn’t have to exist. However, every day, numerous individuals experience physical injury as a direct result of another’s actions (or in some cases, lack of action). Now, this field is expansive and can cover a whole cornucopia of areas, ranging from accidents abroad, asbestos-related sickness, bus accidents, criminal injury, motorcycle accidents, noise-induced hearing loss, slips and trips, pavement accidents and much more. However, the most common area of personal injury tends to be “accidents in the workplace” and “accidents on commercial properties”. If you experience any form of an accident outside of your home that is directly due to the neglect or malpractice of another, you should claim. Why? Well, the injuries and trauma that you endure not only deserve compensation in their own right, but they could cause you to make significant losses financially too. After all, how are you supposed to earn a living if you are suffering from the consequences of the situation? To effectively and fairly carry out a personal injury claim, use a reputable law firm for injury. Using a firm that solely focuses on personal injury will ensure that you get the most focused and specialist help available to you.

Missold Insurance

Missold insurance tends to be an area that is now commonly associated with compensation culture. Why? Well, hundreds of thousands of people have begun to realise or be informed that they were missold insurance plans and they can rightfully claim back the full amount plus compensation. Now, if you knowingly took the policy out and were happy to pay it, you shouldn’t use this as an opportunity to rake some money back in. However, if you were genuinely missold an insurance that you were convinced you had to take out when you didn’t or were encouraged to take out a policy that you couldn’t actually benefit from, by all means, take action. Perhaps an area to focus on is PPI or payment protection insurance, as this has an upcoming deadline that you have to claim ahead of. This form of insurance was frequently missold as an add-on to various types of loans, from unsecured cash loans to credit cards. The purpose of the insurance was to ensure that you could keep up with loan repayments even if you experienced a change in income due to job loss or illness, however it was often added on to loan agreements without the participant’s success, or sold to them in full knowledge that they would never really be eligible to claim on it.

As you can see, compensation cases when carried out for the wrong reasons or when exaggerated are, of course, a drain on wider society. However, if you know well that you have unjustly experienced inconvenience, harm, or loss at the hands of another, you shouldn’t be ashamed to put forward a claim.
