The judge has asked both parties to submit a statement by May 9 that contains a truthful assessment on their claims and defenses.  Judge Lucy Koh, the presiding judge over the two lawsuits Apple has charged to Samsung has ordered the alternative dispute resolution. It is believed that Spero is the ideal mediator between the two parties since he is not directly involved with the lawsuit.

Apple CEO Tim Cook, stated in an interview:

“I've always hated litigation, and I continue to hate it. We just want people to invent their own stuff. And so if we could get to some kind of arrangement where we could be assured that's the case and a fair settlement on the stuff that's occurred, I would highly prefer to settle versus battle. But it — the key thing is that it's very important that Apple not become the developer for the world. We need people to invent their own stuff.”

In contrast with the late Steve Jobs, Cook appears to be softer and mild-mannered. Jobs even told his biographer that he was willing to go “thermonuclear war” against Google and spend every dollar of the Company’s bank balance to demolish Android, Google’s operating system.
